Terms of Service

1. Acceptance of Terms

By accessing or using Treki (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Treki.

2. Eligibility

You must be at least 13 years of age to use Treki. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You may not create multiple accounts or share your account with others.
• You may delete your account at any time through Settings.

4. User-Generated Content

Treki allows you to post reviews, ratings, comments, and create lists ("User Content"). You retain ownership of your User Content, but you grant Treki a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with the Service.

You agree that your User Content will not:

• Contain hate speech, harassment, threats, or discriminatory language
• Include sexually explicit, pornographic, or obscene material
• Promote violence, self-harm, or illegal activities
• Infringe on any third party's intellectual property rights
• Contain spam, advertisements, or solicitations
• Include personal information of others without their consent
• Impersonate any person or entity

5. Content Moderation

We reserve the right to review, remove, or disable access to any User Content that violates these Terms or is otherwise objectionable, at our sole discretion and without notice. Users can report content they believe violates these Terms using the report function available on reviews, comments, and user profiles.

Users also have the ability to block other users. Blocked users will not be able to interact with the blocking user's content.

6. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, bully, or intimidate other users
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Circumvent any content moderation or safety features

7. Intellectual Property

The Treki name, logo, branding, and platform code are owned by Treki and protected by intellectual property laws. Music metadata (album names, artwork, track listings) is sourced from the Apple Music/iTunes API and is the property of their respective owners. User Content remains the property of the respective users.

8. Account Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service. You may delete your account at any time through Settings → Delete Account. Upon deletion, your data will be permanently removed within 30 days.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Treki shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with applicable laws. You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

12. Apple App Store Terms (EULA)

If you access Treki through the Apple App Store, you also agree to the following:

• These Terms are between you and Treki, not Apple. Treki is solely responsible for the Service and its content.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event of any failure to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if applicable). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the Service, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
